Terms of Use — Luxwell
These Terms of Use (“Terms”) govern your use of the Luxwell mobile application and related services (the “App”). By downloading, installing, or using the App, you agree to these Terms. If you do not agree, do not use the App.
1. The App and eligibility
Luxwell helps you estimate scene brightness with a live incident, reflected, and spot meter on iPhone, and includes a Sunny 16 exposure calculator. Optional Pro tools include a zone system scale, calibration, a local shoot log, a film ISO helper, and extra camera presets. The App is intended as a photographic exposure aid, not as laboratory metrology, scientific measurement, or professional lighting-certification equipment. You must be able to form a binding contract in your jurisdiction and comply with applicable law. You are responsible for how you use meter readings when you expose film or digital captures.
2. Your data and local storage
Settings, calibration, presets, and shoot-log data are stored locally on your device as described in our Privacy Policy. You are responsible for backing up or exporting information you need to retain. PaprikaTech is not responsible for loss of data caused by device failure, uninstalling the App, or failure to export a shoot log elsewhere.
3. Pro access and purchases
The live meter and Sunny 16 calculator are available without Pro access and have no usage quota. Pro access unlocks the zone system scale, manual or guided calibration, shoot log and export, film ISO helper, and extra camera presets.
Pro access is available through Luxwell Pro, a one-time in-app purchase processed through Apple’s App Store and validated via our purchase provider (RevenueCat). Pro access does not expire unless required by law or these Terms. Prices, refunds, and Restore Purchases are governed by Apple’s payment policies unless otherwise required by law.
4. Meter readings and professional use
Luxwell uses your iPhone camera to estimate scene brightness. Results are useful for exposure decisions but are not laboratory-grade and may differ from a calibrated handheld meter. Readings depend on device sensors, scene content, haze, latitude, and subject brightness. Sunny 16 and guided calibration are approximate. You should verify important exposures on a test roll or with a handheld meter when accuracy matters. PaprikaTech does not guarantee that App output meets any professional, scientific, or regulatory measurement standard in your jurisdiction.
5. Acceptable use
You agree not to:
- Use the App for unlawful, harmful, or abusive purposes
- Attempt to reverse engineer, scrape, or overload the App except as allowed by law
- Circumvent security, licensing, or Pro access requirements
- Use the App in ways that infringe others’ rights or violate applicable policies
6. Intellectual property
The App, branding, and materials provided by PaprikaTech are owned by PaprikaTech or its licensors and are protected by intellectual property laws. These Terms grant you a limited, non-exclusive, revocable license to use the App for personal or internal business purposes in accordance with these Terms and the App Store rules. You retain ownership of notes and logs you create, subject to your rights and any third-party restrictions on content you use.
7. Privacy
Our Privacy Policy explains how we handle information. It is incorporated into these Terms by reference.
8. Disclaimers
THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT UNINTERRUPTED OR ERROR-FREE OPERATION.
9. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, PAPRIKATECH AND ITS AFFILIATES, OFFICERS, AND EMPLOYEES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, FILM, OR GOODWILL, ARISING FROM YOUR USE OF THE APP, INCLUDING EXPOSURE DECISIONS BASED ON METER READINGS. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE APP WILL NOT EXCEED THE GREATER OF (A) AMOUNTS YOU PAID US FOR THE APP IN THE TWELVE MONTHS BEFORE THE CLAIM OR (B) FIFTY U.S. DOLLARS ($50), EXCEPT WHERE SUCH LIMITATIONS ARE PROHIBITED BY LAW.
10. Indemnity
You agree to indemnify and hold PaprikaTech harmless from claims arising out of your misuse of the App, your meter or log content, your violation of these Terms, or your violation of third-party rights, except to the extent caused by our gross negligence or willful misconduct.
11. Changes
We may update these Terms or the App. We will post revised Terms with a new “Last updated” date. Continued use after changes constitutes acceptance. Material changes may also be communicated through the App or App Store listing where appropriate.
12. Termination
You may stop using the App at any time by uninstalling it. We may suspend or discontinue the App or your access if you breach these Terms or if required for legal or safety reasons.
13. Governing law
These Terms are governed by the laws of the Commonwealth of Pennsylvania, USA, without regard to conflict-of-law rules, except where mandatory consumer protections in your country or state of residence apply.
